Debtor Frequently Asked Questions
You need to speak with your attorney. Our office is not allowed to give permission for you to skip a payment, but there are options and procedures that your attorney can help you with.
You will need to contact our office in order to see if you can make arrangements. If your delinquency is more than one month, you will need to speak with your attorney about your options.
If you sent a check that was returned due to insufficient funds, you will need to send a replacement check. The funds will not be re-deposited.
Our office will file a Notice of Plan Completion, and you will need to contact your attorney to file your final paperwork. It can take up to three months for your paperwork to be completed and for you to receive your discharge order.
For answers to these questions, you will need to call our office. We will take your information and respond in writing with your payoff information.
You must speak with your attorney. Our office cannot give legal advice, and thus, we cannot give you the guidance or permission to do these things. Your attorney can explain the appropriate procedures and tell you about your options.
You need to speak with your attorney and have the insurance company contact your attorney in order to file the appropriate paperwork.
Creditors generally release the title when they receive notification that the case is complete. Our office can send them a notice that their claim has been paid prior to case completion, but we cannot force them to release the title. If you have reason to believe that your vehicle claim has been paid in full, contact our office to request this notice.
You should not discuss your case with your creditors. If they attempt to contact you, you should direct them to your attorney.
We need your employer’s name and new address in writing. You can either call us for an email address or mail a written note to our office at 250 Berryhill Road, Suite 402, Columbia, SC 29210.
For the Financial Management course requirement, my office will cover the cost of the required Debtor Education course for cases if taken within one year of confirmation. You must use the course designed by TEN (Trustees’ Education Network). Visit the TEN website (www.13class.com) and register using this trustee’s identifier: TEN13045.
